Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Detail Pro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is owned and operated by Apex Integrations LLC ("we," "us," or "our").

2. Description of Service

Detail Pro is a mobile application designed for mobile detailing professionals to manage their business operations, including but not limited to:

• Customer relationship management
• Appointment scheduling and tracking
• Service and expense tracking
• Automated customer messaging
• Team management and access roles
• Business analytics and reporting
• Optional online payment acceptance via Stripe Connect

3. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

To use the App, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription Plans and Payment

Detail Pro offers the following subscription tiers:

• Basic: Customer management, scheduling, service and expense tracking, up to 10 team members.
• Core: Everything in Basic plus automated customer messaging (500 messages/month), in-app messaging hub, and online booking.
• Elite: Everything in Core plus 1,000 messages/month and unlimited team members.

Subscriptions are billed through the Apple App Store or Google Play Store. All payments are processed by the respective platform. Prices are subject to change with notice. You may cancel your subscription at any time through your device's subscription settings.

6. Free Trial

We may offer a free trial period for new users. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate. Trial eligibility is determined at our sole discretion.

7. Promo Codes

From time to time, we may issue promotional codes that provide discounts or other benefits. Promo codes are subject to specific terms and conditions provided at the time of issuance, are non-transferable, and may not be combined with other offers unless expressly permitted.

8. User Data and Content

You retain ownership of all data you enter into the App, including customer information, appointment records, and business data. You are solely responsible for the accuracy and legality of the data you input. By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the service.

9. Automated Messaging

The App provides automated text messaging features for customer communication. You are solely responsible for ensuring that you have obtained proper consent from your customers before sending automated messages. You agree to comply with all applicable laws and regulations regarding electronic communications, including but not limited to the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.

10. Online Payments and Stripe Connect (Optional Feature)

Detail Pro+ includes an optional online payments feature powered by Stripe Connect. When you enable this feature:

• You create a separate Stripe Connect account that is yours, not Apex Integrations LLC's. You are the merchant of record for all payments processed through that account.
• All customer payments are deposited directly into your Stripe account. Apex Integrations LLC does not hold, route, or take a percentage of these funds.
• You are solely responsible for the goods and services you provide to your customers, including service quality, scheduling, taxes, disputes, refunds, and chargebacks. Apex Integrations LLC is not a party to any transaction between you and your customers.
• Refunds to your customers are issued by you through Stripe. Apex Integrations LLC cannot issue refunds on your behalf.
• You agree to comply with Stripe's Connected Account Agreement, Stripe's Services Agreement, and all applicable laws — including those related to consumer protection, anti-money laundering, sales tax collection, and income tax reporting.
• Stripe charges its standard processing fees (currently 2.9% + $0.30 per transaction for US card payments) directly from each transaction. Apex Integrations LLC does not charge an additional platform fee on payments processed through the App.
• Stripe may charge optional per-transaction fees for fraud-prevention features (such as Radar for Fraud Teams) directly to your Stripe account. These fees are between you and Stripe.
• Apex Integrations LLC may, in its sole discretion, suspend, disable, or remove the online payments feature for any account at any time, including in response to suspected fraud, violation of these Terms, or upon Stripe's request.

11. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any part of the App
• Use the App to send unsolicited or unauthorized messages (spam)
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App in a manner that could damage, disable, or impair the service

12. Intellectual Property

The App, including its design, features, and content (excluding user data), is the property of Apex Integrations LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

13. Limitation of Liability

To the maximum extent permitted by law, Apex Integrations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

14. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease. You may export your data prior to termination by contacting us.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
